With lower estate tax rates and higher income rates, many traditional estate planning techniques result in only modest overall tax savings due to the income tax basis set-up lost when assets are moved out of clients' taxable estates. While most estate planners are aware of this issue, planners now must decide how to proceed with clients that have already transferred assets out of their taxable estates and with new clients who come for estate planning recommendations.
Allan and Eva will cover how to rescue traditional plans undertaken before the change in tax rates, when new client plans must take into account the lost basis step-up.

  • Learn how traditional estate plans have changed in the "new world" where income tax and estate tax rates are essentially equal.
  • Gain insight on how to rescue traditional estate plans that were undertaken before the change in tax rates.
  • Understand newer planning alternatives to avoid the income tax downside of moving assets out of a taxable estate.

Major Subjects:

  • Income tax and traditional estate plans
  • How portability affects estate planning
  • Planning for assets that will never be sold vs. assets that will be sold during life vs. assets that will be sold after death
  • Buy-back technique and intentionally defective grantor trusts
